  6. Resco, Ltd. Software License and Limited Warranty
  7. This legal document is an agreement between you, THE LICENSEE,
  8. and Resco, Ltd. THE LICENSOR. By executing the program
  9. files, you agree to be bound by the terms of this agreement,
  10. which includes the Software License, Limited Warranty and
  11. Acknowledgment. If you do not agree to the terms presented in this
  12. agreement, DO NOT OPEN the program files. In order to protect our
  13. rights, Resco, Ltd. does not SELL any rights to software.
  14. Rather Resco, Ltd. grants the Right to Use the software by
  15. means of a SOFTWARE LICENSE. Resco, Ltd. specifically
  16. retains the title to all Resco, Ltd. computer software.

  18. SOFTWARE LICENSE

  20. 1. Grant of a License. In consideration of payment of The LICENSE FEE
  21. (part of the price you paid for this product), and your agreement
  22. to abide by the terms and conditions of this License and the Limited
  23. Warranty, Resco, Ltd., THE LICENSOR, grants you,THE LICENSEE,
  24. a non-exclusive right to use this copy of the Resco, Ltd.
  25. software program named "Resco Picture Viewer" on the number
  26. of computers specified in the heading of this License so long as you
  27. comply with the terms of this License.

  29. 2. Ownership of Software. As a Licensee, you own the physical
  30. media on which the software is originally or subsequently recorded,
  31. but an express condition of this License is that Resco, Ltd.
  32. retains title and ownership of the Software recorded on the
  33. original disk(s) and all subsequent copies of the Software,
  34. regardless of the form or media in or on which the original and other
  35. copies may exist. This License is NOT a sale of the original
  36. Software or any copy.

  38. 3. Copying Restrictions. This software and the accompanying written
  39. materials are the subject of copyright. Unauthorized copying of the
  40. software, including Software that has been modified, or of the written
  41. materials is expressly forbidden. You may be held legally responsible
  42. for any copyright infringement which has been encouraged or caused
  43. by the failure to abide by the terms of this License.

  45. 4. Use Restrictions. As the Licensee, you may physically transfer
  46. the Software from one computer to another provided that the Software
  47. is used on only the number of computers specified in the heading
  48. of this License at any one time. You may not distribute copies of
  49. the Software or accompanying written materials to others. You may
  50. not modify, adapt, translate, reverse engineer, disassemble, decompile,
  51. or create derivative works based on the Software. You may not modify,
  52. adapt, translate, reverse engineer, disassemble, decompile, or create
  53. derivative works based on the written materials without the prior
  54. written consent of Resco, Ltd.

  56. 5. Other Limitations. Limitations on Reverse Engineering,Decompilation,
  57. and Disassembly. You may not reverse engineer, decompile, or
  58. disassemble the SOFTWARE, except and only to the extent that such
  59. activity is expressly permitted by applicable law notwithstanding this
  60. limitation. Separation of Components. The SOFTWARE is licensed as
  61. a single product. Its component parts may not be separated for use on
  62. more than one computer.
  63. Rental or Lease. You may not rent or lease the SOFTWARE.
  64. Software Transfer. You may permanently transfer all your rights
  65. under this License, provided you retain no copies; you transfer
  66. all of the SOFTWARE, including all component parts, the media, any
  67. upgrades and this License; and the recipient agrees to the terms
  68. of this License.

  70. 6. Termination. Without prejudice to any other rights, Right to
  71. Left Software may terminate this License if you fail to comply with
  72. the terms and conditions of this License. In such event, you must
  73. destroy all copies of the SOFTWARE and all of its component parts.

  75. 7. Miscellaneous. This License shall be governed and construed
  76. inaccordance with the International laws and shall benefit
  77. Resco, Ltd., its successors and assigns.

  79. LIMITED WARRANTY AND DISCLAIMER OF WARRANTY

  81. The software and accompanying written material (including
  82. instructions for use) are provided  "as is" without warranty of any
  83. kind. Further, Resco, Ltd. does not warrant, guarantee or make
  84. any representations regarding the use or the results of use, of
  85. the Software or written materials in terms of correctness, reliability,
  86. accuracy or fitness for purpose. The entire risk as to the results
  87. and performance of the software is assumed by you. Should the
  88. software be defective, you and not Resco, Ltd. or its dealers,
  89. agents, distributors or employees, assume the entire cost of all
  90. necessary repair, servicing and correction.

  92. The above is the only warranty of any kind, either express or
  93. implied, including but not limited to the warranties of
  94. merchantability and fitness for purpose, that Resco, Ltd. makes
  95. regarding this product. No oral or written information or advise given
  96. by Resco, Ltd. or its dealers, agents, distributors or employees
  97. shall create a warranty or in any way increase the scope
  98. of this warranty.

  100. Neither Resco, Ltd. nor anyone else who has been involved in
  101. the creation, production or delivery of this product shall be liable
  102. for any direct, indirect, consequential or incidental damages ( including
  103. damages for loss of business profits, business interruption, loss
  104. of business information, and the like.) arising out of the use or inability
  105. to use this product even if Resco, Ltd. has been advised of
  106. the possibility of such damages.

  110. You acknowledge that you have read this License and Limited Warranty,
  111. understand them, and agree to be bound by their terms and conditions.
